The Canadian Representative service, in full

We act as the Canadian Representative named on your ISED certification application, as required by RSP-100 section 4.1 when the applicant's address is outside Canada. You get a signed attestation letter the same business day, and for the life of the appointment we are the Canadian point of contact for ISED and your certification body on that product. Price: US$499 per certified product, paid once, covering the appointment for as long as the product is offered on the Canadian market.

The regulatory role we accept

RSP-100 puts three responsibilities on the Canadian Representative, and our letter accepts each of them expressly:

"The Canadian representative shall be responsible for responding to all enquiries from ISED regarding the certified product(s), including providing audit samples at no charge to ISED. The applicant shall have a valid Application and Agreement for Certification Services for as long as the certified product is offered on the Canadian market." — RSP-100, Issue 12, section 4.1

In practice that means a Canadian address and a reachable Canadian contact on the certification record; a commitment to receive and answer ISED enquiries about the certified product; and a commitment to make audit samples available to ISED when requested. The representative does not make technical claims about your product and is not a substitute for the certification body or the test lab. What is included

The attestation letter. A signed PDF on Smutylo Law+ letterhead, dated, identifying the applicant (legal name, address, ISED Company Number), the product (IC certification number, PMN, HVIN, model numbers), the representative (our legal name, Ottawa address, email, phone) and the acceptance of RSP-100 section 4.1 responsibilities for the stated term. We format it to the field list certification bodies actually check; see attestation letter required fields. If your CB has its own template, we sign that instead at no extra cost.

ISED enquiry handling. If ISED's Certification and Engineering Bureau or your CB contacts us about the product, we acknowledge receipt, forward the enquiry to your designated contact the same business day, and relay your response. We do not answer technical questions on your behalf without your written instructions.

Audit sample coordination. When ISED requests a post-certification audit sample under RSP-100 section 12.2, we coordinate shipping instructions between you and ISED so the sample arrives correctly addressed and documented. The sample itself and its shipping are at the applicant's expense, as the procedure requires.

Record keeping. We keep the appointment on file with your contact details and remind you to update them when they change. A stale applicant contact is the most common reason an ISED enquiry goes unanswered; see common Canadian Representative mistakes.

Revisions. New models added under the same certification, company name changes and address corrections are handled through the revision form, free of charge, with no time limit and no cap on how many you request.

What is not included

Testing, certification filing, listing in ISED's Radio Equipment List, labelling review, or technical compliance advice. Those are the jobs of your laboratory and certification body, and we work alongside both. Term

The appointment continues for as long as the product is offered on the Canadian market — the same period ISED requires a representative to be maintained. The US$499 fee is paid once; there is no renewal date and no second invoice. Once a year we ask you to confirm which certified products are still offered in Canada, and when a product is withdrawn the appointment ends and we close the file. Who provides it

Can the certification body's own representative form be used instead of your letter?

Yes. Several CBs and FCBs use their own Canadian Representative declaration. Send it with your order and we will complete and sign it, at no additional cost.

Do you act as representative for terminal equipment under DC-01 as well?

Yes. The same Canadian contact requirement applies to terminal equipment registered under DC-01 section 6. Tell us on the form if your product is terminal equipment rather than radio apparatus so the letter cites the right procedure.

Will you appear as the applicant or the certificate holder?

No. You remain the applicant and certificate holder. We are the Canadian Representative identified on the application, nothing more.
